1. LEGAL NOTICE AND INFORMATION AND ACCEPTANCE THEREOF
This legal notice and information (hereinafter, the “Legal Notice”) governs the use of the internet website service: Domain www.some.es (hereinafter, “The Portal”) placed at the disposal of internet users by SOME, S.A.
SOME, S.A. with registered office at C/. BELLMUNT, 120 - 08580 SANT QUIRZE DE BESORA (Barcelona) and the holder of tax number (CIF) A08328908.
The use of the Portal attributes the condition of Portal user (hereinafter, the "User" or “Users”) and implies full acceptance without reservation of each of the provisions included hereunder in the version published by SOME, S.A. the moment the User accesses the Portal. Consequently, Users shall carefully read this Legal Notice each time they propose to use this Portal, since said notice may be amended.
The use of certain services offered to Users across this Portal is subject to the particular conditions of the service in question (hereinafter, the “Particular Conditions”) which, depending on each case, replace, complete and/or amend this Legal Notice. Therefore, prior to using said services, Users shall also carefully read the pertinent Particular Conditions.
Likewise, the use of the Portal is subject to all the notices, rules of use and instructions relayed to Users by SOME, S.A. which replace, complete and/or amend this Legal Notice.
2. SUBJECT MATTER
Across this Portal, SOME, S.A. provides Users with the access to and use of different services and content (hereinafter, the “Services”) placed at their disposal by SOME, S.A. or third parties.
3. CONDITIONS OF ACCESS AND USE OF THE PORTAL
3.1. Free nature of access and use of the Portal
The provision of the Services on the part of SOME, S.A. is free to Users. Notwithstanding the foregoing, some of the Services provided by SOME, S.A. or by third parties across the Portal are subject to the payment of a price in the form set forth under the pertinent Particular Conditions.
3.2. User Registration
As a general rule, the provision of the Services does not require prior subscription or registration of Users.
Nonetheless, SOME, S.A. restricts the use of certain Services to the prior completion of the pertinent User registration forms. Said registration shall be done in the manner expressly indicated in the service itself or in the Particular Conditions that regulate it.
3.3. Veracity of the information
All information provided by Users across the Services shall be truthful. For purposes hereof, Users guarantee the authenticity of all data they might communicate consequent on completing the forms required for subscription to the Services. Likewise, Users shall be responsible for keeping all the information provided to SOME, S.A. permanently updated such that it responds to the true situation of Users at all times. In any case, Users shall be solely liable for any false or inaccurate representations that they might make and for any damage caused to SOME, S.A. or to third parties consequent on the information provided.
3.4. Minors
To be able to use the Services, minors will have to obtain permission beforehand from their parents, tutors or legal representatives, who shall be responsible for all the acts carried out by the minors under their charge.
Full responsibility for determining the particular content and Services that minors may access corresponds to the adults who are in charge of them. Since the Internet makes it possible to access content that might not be suitable for minors, Users are informed that there are mechanisms, particularly filter and blocking programs, that can limit the content available and, even though not infallible, they are especially useful for controlling and restricting the material which minors can access.
3.5. Obligation to make correct use of the Portal and the Services
Users undertake to use the Portal and the Services in accordance with the law, this Legal Notice, the Particular Conditions governing certain Services and any other notices, rules of use and instructions relayed to them as well as accepted principles of morality and public order.
For said purposes, Users shall refrain from using any of the Services with unlawful objectives or purposes, prohibited hereunder, damaging to the rights and interests of third parties or that in any manner might damage, render useless, overload, deteriorate or prevent the normal use of the Services, the computer equipment or the documents, files and all types of content stored in any computer equipment (hacking) of SOME, S.A., of other Users or of any Internet user (hardware and software).
In particular, and purely by way of illustration and not limitation, Users undertake to not transmit, divulge or make available to third parties any information, data, content, messages, graphics, designs, sound and/or image files, photographs, recordings, software and, in general, any class of material that might:
(a) be, in any manner, contrary to, impair or infringe the fundamental rights and public liberties acknowledged by the Spanish Constitution, international Treaties and any other legislation;
(b) induce, incite or foster actions that are criminal, degrading, defamatory, slanderous or violent actions or, in general that are contrary to the law, accepted principles of morality or public order;
(c) induce, incite or foster discriminatory actions, attitudes or thoughts by reason of sex, race, religion, beliefs, age or status;
(d) incorporate, make available or permit access to products, elements, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, accepted principles of morality or public order;
(e) induce an unacceptable state of anxiety or fear;
(f) induce or incite others to get involved in practices that are dangerous, high risk or harmful to physical and mental well-being;
(g) be false, ambiguous, inaccurate, exaggerated or extemporaneous that induces or might induce error in regard to its purpose or the intentions or aims of the source;
(h) be protected by any intellectual or industrial property rights belonging to third parties without Users having previously obtained from the holders thereof the authorisation required to carry out the use they make or intend to make;
(i) violate third-party trade secrets;
(j) be contrary to the right to honour, personal and family privacy or personal image;
(k) impair in any way the credit of SOME, S.A. or third parties;
(l) violate the rules on secrecy of communications;
(m) constitute, as the case may be, unlawful, deceitful or unfair advertising and, in general, constitute unfair competition;
(n) incorporate a virus or other physical or electronic elements that might damage or prevent the normal functioning of the network, the system or computer equipment (hardware and software) of SOME, S.A. or third parties or that might damage the electronic documents and files stored in said computer equipment;
(o) cause, due to its characteristics (such as format, length, etcetera) difficulties in the normal operation of the Service, or
(p) contain HTML labels other than those expressly authorised by SOME, S.A.
3.6. Obligation to make correct use of the Content
In accordance with clause 3.5, Users undertake to use the content made available to Users on the Portal, which is understood, by way of illustration and not limitation, to be the texts, photographs, graphics, images, icons, technology, software, links and any other audio-visual or sound content as well as their graphic design and source codes (hereinafter, the “Content”) in compliance with the law, this Legal Notice and the Particular Conditions of certain Services and other notices, rules of use and instructions relayed to them as well as accepted principles of morality and public order, and in particular, they undertake to refrain from:
(a) reproducing, copying, distributing, making available or in any other form publicly communicating, transforming or modifying the Content, except with the authorisation of the holder of the corresponding rights or where permitted by law;
(b) suppressing, manipulating or in any other form altering the "copyright" and other data identifying the rights reserved of SOME, S.A. or its holders, fingerprints or any other technical means established for their recognition.
Users shall refrain from obtaining or even trying to obtain the Content using means or procedures other than those with which they might have been provided or that have been indicated for this purpose on the web pages where the Content is located or, in general, those regularly used on the Internet for this purpose provided that they entail no risk of damaging or rendering useless the Portal, the Services and/or the Content.
3.7. Use of the Services offered on this Portal in accordance with the Anti-Spamming Policy of SOME, S.A.
Users undertake to refrain from:
(i) collecting data for advertising purposes or sending advertising of any kind and communication for purposes of sale or of another commercial nature without the prior request and corresponding consent;
(ii) sending any other messages not previously solicited or consented to a number of persons;
(iii) sending chains of electronic messages not previously solicited or consented;
(iv) using distribution lists which may be accessed across the Services in order to carry out the activities indicated in points (i) to (iii) above, and
(v) making available to third parties, for any purpose, data collected from distribution lists.
Users or third parties affected by the reception of non-solicited messages addressed to a number of persons may notify same to SOME, S.A. by sending a message to the following electronic mail address: info@some.es
3.8. Introduction of hyperlinks that permit access to the pages of this Portal and the Services
Users and, in general, any persons who intend to set up a hyperlink between their website and this Portal (hereinafter, the "Hyperlink") shall comply with the following conditions:
(a) the Hyperlink shall only give access to the home-page or start page of this Portal, but may not reproduce them in any way;
(b) no frame shall be created on the web pages of this Portal;
(c) no false, inaccurate or incorrect representations or indications shall be made about SOME, S.A., its management, its employees, the pages of this Portal or the Services provided;
(d) no statement shall be made nor shall it be implied that SOME, S.A. has authorised the Hyperlink or has supervised or in any way assumed the services offered or made available on the website on which the Hyperlink is set up;
(e) an exception to the foregoing are any signs that form part of the actual Hyperlink; the web page on which the Hyperlink is set up shall contain no trademark, brand name, name, logotype, slogan or other distinctive signs belonging to SOME, S.A., and
(f) the website on which the Hyperlink is set up shall not contain information or unlawful content that might be contrary to accepted principles of morality or public order, nor shall it contain content that is contrary to any rights of third parties.
The setting up of the Hyperlink on no account implies the existence of relations between SOME, S.A. and the owner of the website on which it is set up, nor the acceptance or approval on the part of SOME, S.A. of its content or services.
4. NO LICENCE
All the brands, commercial names and distinctive signs of any kind that appear on the Portal belong to SOME, S.A. or third parties and it may not be understood that the use of or access to the Portal and/or the Services might attribute to the User any right whatsoever over said brands, commercial names and/or distinctive signs.
The Content is also the intellectual property of SOME, S.A. or third parties and, by virtue hereof, none of the exploitation rights that exist or might exist over said Content may be understood to be granted to the Users over and above that which is strictly necessary for the correct use of the Website and the Services.
5. EXCLUSION OF WARRANTIES AND LIABILITY.
5.1. Exclusion of warranties and liability due to the operation of the Portal and the Services
5.1.1. Availability and continuity, use and fallibility
SOME, S.A. does not warrant the availability and continuity of the operation of the Portal and the Services. Where reasonably possible, SOME, S.A. shall give prior notice of any interruptions of the operation of the Portal and the Services. Neither does SOME, S.A. warrant the use of the Website and the Services for carrying out any activity in particular, nor its infallibility, particularly, although not exclusively, that Users may effectively use the Portal and the Services, access different web pages that comprise the Portal or those from which the Services are provided. .
SOME, S.A. EXCLUDES, AS EXTENSIVELY AS IS PERMITTED BY LAW, ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM THE LACK OF AVAILABILITY OR CONTINUITY OF THE OPERATION OF THE PORTAL AND THE SERVICES, ANY FRAUD IN THE USE THAT USERS MIGHT ATTRIBUTE TO THE PORTAL AND THE SERVICES, THE FALLIBILITY OF THE PORTAL AND THE SERVICES, AND IN PARTICULAR, THOUGH NOT EXCLUSIVELY, FROM ANY FAULTS OF ACCESS TO THE DIFFERENT WEB PAGES OF THE PORTAL OR FROM PAGES FROM WHICH THE SERVICES ARE PROVIDED.
5.1.2. Privacy and security in the use of the Portal and the Services
SOME, S.A. does not warrant privacy or security when using the Portal and the Services, and in particular, it does not warrant that unauthorised third parties may not know of the class, conditions, characteristics and circumstances of the use that Users make of the Portal and the Services.
SOME, S.A. EXCLUDES, AS EXTENSIVELY AS IS PERMITTED BY LAW, ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM THE KNOWLEDGE THAT UNAUTHORISED THIRD PARTIES MIGHT HAVE OF THE CLASS, CONDITIONS, CHARACTERISTICS AND CIRCUMSTANCES OF THE USE THAT USERS MAKE OF THE PORTAL AND THE SERVICES.
5.2. Exclusion of warranties and liability for the Content
5.2.1. Quality
SOME, S.A. does not control or warrant the absence of virus or other elements from the Content that might alter your information system (software and hardware) or from the electronic documents and files stored in your information system.
SOME, S.A. EXCLUDES, AS EXTENSIVELY AS IS PERMITTED BY LAW, ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM THE PRESENCE OF VIRUS OR OTHER ELEMENTS IN THE CONTENT THAT MIGHT ALTER THE INFORMATION SYSTEM OR ELECTRONIC DOCUMENTS AND FILES OF THE USERS.
5.2.2. Legality, reliability and use
SOME, S.A. does not warrant the legality, reliability or use of the Content.
SOME, S.A. EXCLUDES, AS EXTENSIVELY AS IS PERMITTED BY LAW, ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM TRANSMITTING, DISSEMINATING, STORING, MAKING AVAILABLE, RECEIVING, OBTAINING OR ACCESSING THE CONTENT, AND IN PARTICULAR, THOUGH NOT EXCLUSIVELY, FOR ANY DAMAGES THAT MIGHT ARISE FROM:
(A) FAILURE TO COMPLY WITH THE LAW, ACCEPTED PRINCIPLES OF MORALITY AND PUBLIC ORDER CONSEQUENT ON TRANSMITTING, DISSEMINATING, STORING, MAKING AVAILABLE, RECEIVING, OBTAINING OR ACCESSING THE CONTENT;

SOME, S.A. EXCLUDES, AS EXTENSIVELY AS IS PERMITTED BY LAW, ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM THE LACK OF VERACITY, ACCURACY, EXHAUSTIVENESS AND/OR TOPICALITY OF THE CONTENT.
5.3. Exclusion of warranties and liability for the services provided by third parties across the Portal
5.3.1. Quality
SOME, S.A. does not control or warrant the absence of virus or other elements in the services provided by third parties across the Portal that might alter your information system (software and hardware) or in the electronic documents and files stored in your information system.

EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM THE PRESENCE OF VIRUS OR OTHER DAMAGING ELEMENTS IN THE SERVICES PROVIDED BY THIRD PARTIES ACROSS THE PORTAL THAT MIGHT ALTER THE INFORMATION SYSTEM (SOFTWARE AND HARDWARE) OR IN THE ELECTRONIC DOCUMENTS AND FILES STORED IN THE INFORMATION SYSTEM OF THE USERS.
5.3.2. Legality, reliability and use
SOME, S.A. does not warrant the legality, reliability or usefulness of the services provided by third parties across the Portal.
SOME, S.A. EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM THE SERVICES PROVIDED BY THIRD PARTIES ACROSS THE PORTAL, PARTICULARLY, THOUGH NOT EXCLUSIVELY, FOR ANY DAMAGES THAT MIGHT ARISE FROM:
(A) FAILURE TO COMPLY WITH THE LAW, ACCEPTED PRINCIPLES OF MORALITY AND PUBLIC ORDER CONSEQUENT ON THE PROVISION OF SERVICES BY THIRD PARTIES ACROSS THE WEBSITE;
(B) THE INFRINGEMENT OF THE INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS, TRADE SECRETS, CONTRACTUAL COMMITMENTS OF ANY KIND, RIGHTS TO HONOUR, PERSONAL AND FAMILY PRIVACY AND IMAGE, PROPERTY RIGHTS AND RIGHTS OF ANY OTHER NATURE BELONGING TO A THIRD PARTY CONSEQUENT ON THE PROVISION OF SERVICES BY THIRD PARTIES ACROSS THE PORTAL;

5.4. Exclusion of warranties and liability for information, content and services that are hosted outside the Portal
The Portal makes available to Users linking devices (such as, for example, links, banners and buttons), directories and search tools that enable Users to access websites belonging to and/or managed by third parties (hereinafter, “Linked Sites”). The sole purpose of installing these links, directories and search tools on the Portal is to make it easier for Users to search for and access the information, content and services available on the Internet.
The results of the search tools are provided directly by third parties and are consequent on the automatic operation of technical mechanisms, wherefore SOME, S.A. cannot control and does not control these results and, in particular, among which might appear Internet sites the content of which might be unlawful, contrary to accepted principles of morality or considered to be inappropriate for other reasons. In the event that a user should consider that any of the sites included in the search results contains unlawful activity or information and wishes to request the elimination of the link, said user may start the procedure provided in clause seven hereof.
SOME, S.A. does not sell directly or through any third party the information, content and services available on the Linked Sites, nor does it control them beforehand, approve, recommend, guard or make them its own. Therefore, Users should take every precaution when evaluating and using the information, content and services that exist on the Linked Sites.
SOME, S.A. DOES NOT WARRANT OR ASSUME ANY KIND OF LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM:
(A) THE OPERATION, AVAILABILITY, ACCESSIBILITY OR CONTINUITY OF THE LINKED SITES;
(B) THE MAINTENANCE OF THE INFORMATION, CONTENT AND SERVICES EXISTING ON THE LINKED SITES;
(C) THE PROVISION OR TRANSMISSION OF THE INFORMATION, CONTENT AND SERVICES EXISTING ON THE LINKED SITES;
(D) THE QUALITY, LEGALITY, RELIABILITY AND USEFULNESS OF THE INFORMATION, CONTENT AND SERVICES EXISTING ON THE LINKED SITES UNDER THE SAME TERMS AND WITH THE SAME SCOPE AS PROVIDED IN GENERAL CONDITION 5.2 AND 5.3 WITH RESPECT TO THE CONTENT AND THE SERVICES PROVIDED BY THIRD PARTIES ACROSS THE PORTAL.
5.5. Exclusion of warranties and responsibility for the use of the Portal, the Services and the Content by Users
SOME, S.A. is not obliged to control nor does it control the use that Users make of the Portal, the Services and the Content. In particular, SOME, S.A. does not guarantee that Users use the Portal, the Services and the Content in accordance with this Legal Notice or, as the case may be, with the Particular Conditions that might be applicable, nor that they do so diligently and prudently. Neither is SOME, S.A. obliged to verify or not verify the identity of Users nor the veracity, validity, exhaustiveness and/or authenticity of the data that Users provide about themselves to other Users.
SOME, S.A. EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM THE USE OF THE SERVICES AND THE CONTENT BY THE USERS OR THAT MIGHT ARISE FROM THE LACK OF VERACITY, VALIDITY, EXHAUSTIVENESS AND/OR AUTHENTICITY OF THE INFORMATION THAT USERS PROVIDE ABOUT THEMSELVES TO OTHER USERS AND, IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FOR DAMAGES OF ANY KIND THAT MIGHT ARISE FROM THE SUPPLANTATION OF THE PERSONALITY OF A THIRD PARTY DONE BY A USER IN ANY KIND OF COMMUNICATION MADE ACROSS THE PORTAL.
6. PERSONAL DATA PROTECTION
In order to use some of the Services, Users have to provide SOME, S.A. beforehand with certain personal data (hereinafter, the "Personal Data"). SOME, S.A. shall automate Personal Data treatment for purposes of and under the conditions set forth in its Privacy Policy published at: Domain www.some.es
SOME, S.A. has adopted the levels of security to protect personal date required by law and installs all the technical means at its disposal for additional protection. Users should, however, be aware that Internet security measures are not impregnable.
SOME, S.A. may use cookies when Users navigate the Portal sites and pages. The cookies that may be used on the Portal sites and pages are only associated with the navigator of a certain computer (an anonymous User), and do not in themselves provide the User’s name and surnames. Thanks to the cookies, SOME, S.A. can recognise the navigators of the Users registered after they have signed on for the first time and they do not have to register on each visit to access the areas and Services reserved exclusively for them. The cookies used cannot read the cookie files created by other providers. Users have the possibility of configuring their navigator to be advised on screen of the reception of cookies and to prevent the installation of cookies on their hard drive. (as, for example, the cookies that are used to send advertising or certain Content and make Users visualise advertising or certain Content at the time, number of times and manner, which are all predetermined). 7. PROCEDURE TO BE FOLLOWED IN CASES OF SUSPECTING UNLAWFUL ACTIVITIES
In the event that any User or a third party should consider that there are facts or circumstances that reveal the illegal nature of the use of any Content and/or carrying out any activity on the web pages included or accessible across the Portal and, in particular, the infringement of intellectual or industrial property rights (patents, models and industrial drawings, brands and commercial names, etcetera) or other rights, they should send a notice to SOME, S.A. with the following particulars: (a) personal details of the informant: name, address, telephone number and electronic mail address;
(b) specification of the alleged unlawful activity carried out on the Portal, particularly in cases of an alleged infringement of rights, a precise indication of the content protected and its location on the web pages;
(c) facts or circumstances that reveal the unlawful nature of said activity;
(d) In the event of infringement of rights, a manuscript signature or equivalent with the personal details of the owner of the rights allegedly infringed or the person authorised to act for and on behalf of said owner;
(e) An express clear statement under the responsibility of the informant that the information provided in the notice is exact and of the unlawful nature of the use of the content or the commission of the activities described.
8. NOTICES
All notices and communication (hereinafter, the “Notices”) on the part of Users to SOME, S.A. shall be considered effective for all purposes when they are sent to the User Service Department in one of the following manners:

(c) Sent by electronic mail to the following address: info@some.es
All Notices on the part of SOME, S.A. to Users shall be considered effective for all purposes when they are sent to the User Service Department in one of the following manners:
(1) Notice sent by post to the User’s domicile where this has been previously communicated to
SOME, S.A.;
(2) Notice sent by electronic mail to any of the mailboxes that the User provides or may provide as part of any other service that SOME, S.A. gives to the User;
(3) Communication by telephone on the User’s telephone number where this has been previously notified to SOME, S.A.;
(4) Push messages sent during the provision of the Services on the part of SOME, S.A. to the User.
In this respect, all Notices that are made by SOME, S.A. to Users shall be considered valid if they have been made using the data and across the media indicated above. For the purpose hereof, Users represent that all the data provided are true and correct and they undertake to notify SOME, S.A. of any changes in relation to data for purposes of notice.
9. WITHDRAWAL AND SUSPENSION OF THE SERVICES
SOME, S.A. may withdraw or suspend at any time without prior notice the provision of the Services to any Users that fail to comply with the conditions set forth hereunder.
10. TERM AND TERMINATION
The service provided by the Portal is initially for an open-ended term. SOME, S.A. is, however, authorised to terminate or suspend the service provided by the Portal and/or any of the Services at any time, notwithstanding that provided in this respect in the pertinent Particular Conditions. Where reasonably possible, SOME, S.A. shall give prior notice of the termination or suspension of the Portal Service and the other Services.
11. COOKIES
SOME, S.A. may use cookies when Users navigate the Portal sites and pages. The cookies that may be used on the Portal sites and pages are only associated with the navigator of a certain computer (an anonymous User), and do not in themselves provide the User’s name and surnames. Thanks to the cookies, SOME, S.A. can recognise the navigators of the Users registered after they have signed on for the first time and they do not have to register on each visit to access the areas and Services reserved exclusively for them. The cookies used cannot read the cookie files created by other providers. Users have the possibility of configuring their navigator to be advised on screen of the reception of cookies and to prevent the installation of cookies on their hard drive. Please, read the instructions and manual of your navigator to get more information. To use the Portal, Users do not have to allow the installation of the cookies sent by SOME, S.A., notwithstanding that in such case, they will have to register each time they wish to access a service that requires prior registration.
The cookies that are used on the Portal sites and pages may be sent by SOME, S.A., in which case they are sent from the different servers operated by them or from the servers of certain third parties that provide us with services and send the cookies on behalf of SOME, S.A. (as, for example, the cookies that are used to send advertising or certain Content and make Users visualise advertising or certain Content at the time, number of times and manner, which are all predetermined). As long as Users have not activated the option that prevents the installation of cookies on their hard drive, they may explore their hard drive following the guide and help of their operating system (normally, with Windows operating systems you have to consult the “C” folder (or the unit of disc corresponding to "/Windows/Cookies") to get more details of each server and from where the cookies are sent.

All particulars of this Legal Notice shall be governed by the laws of Spain.
